POWER COUNTY
COMMISSIONER MINUTES
The Board of Power County Commissioners met in regular session on Monday, February 14th, 2011. Present were Commissioners Vicki Meadows, Chairman, and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
COMMISSIONER AGENDA (I.C. #67-2343): Following a review of I.C. #67-2343, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to amend the February 14th, 2011, Commissioner Agenda to include the following items:
Power County Assessor – Access Idaho (Internet Renewal)
Shoshone-Bannock Tribes Pest Control and Agricultural Practices Rules & Regulations
Carried.
POWER COUNTY ASSESSOR – ACCESS IDAHO (INTERNET RENEWAL): Following discussion with Power County Deputy Assessor Elna Neu, it was moved by Commissioner Anderson, seconded by Commissioner Meadows, to approve and execute the Access Idaho Service Level Agreement for electronic transaction and access renewal for the office of the Power County Assessor. Carried.
SHOSHONE-BANNOCK TRIBES – PEST CONTROL & AGRICULTURAL PRACTICES RULES & REGULATIONS (INTERESTED PARTIES): Following discussion with Power County Prosecuting Attorney Randy Kline and Paul Yochum of FMC Corporation, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, that Power County join in any and all comments submitted by the group of “Interested Parties” who may be potentially affected if the Shoshone-Bannock Tribe’s Pest Control & Agricultural Practices Rules & Regulations are adopted. Carried.
POWER COUNTY HISTORIC PRESERVATION BOARD: Moved by Commissioner Anderson, seconded by Commissioner Meadows, to reappoint Dave Bethke to serve an additional term of three (3) years on the Power County Historic Preservation Board (January, 2014). Carried.
POWER COUNTY AIRPORT BOARD: Moved by Commissioner Anderson, seconded by Commissioner Meadows, to reappoint Ron Miller to serve an additional term of three (3) years on the Power County Airport Board (January, 2014). Carried.
POWER COUNTY HUMAN RELATIONS ADVISORY COMMITTEE – POWER COUNTY ORDINANCE #2011-01: Commissioner Meadows announced that it was the date and time scheduled for public hearing on Power County Ordinance #2011-01, which is an ordinance to disband and terminate the Human Relations Advisory Committee. At the outset, Commissioner Meadows authorized Power County Prosecuting Attorney Randy Kline to preside over the public hearing. Following discussion, the opportunity for public input and a finding by the Commissioners that the Notice of public hearing and proposed Ordinance #2011-01 were duly published in The Power County Press on February 9th, 2011, it was moved Commissioner Meadows, seconded by Commissioner Anderson, to approve and adopt Power County Ordinance #2011-01 as published. Carried. Following further discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to close public hearing and instruct Power County Clerk Christine Steinlicht to publish Ordinance #2011-01 as provided by I.C. #31-715 to complete effect. Carried.
POWER COUNTY PROSECUTING ATTORNEY/COMMISSIONERS – MEDIATION: Following discussion, the Commissioners and Power County Prosecuting Attorney Randy Kline agreed to reschedule further consideration of the Mediation Agreement until Commissioner Funk can be present; accordingly, this matter was tabled until February 28th, 2011, at 9:00 a.m.
LANCE FUNK D/B/A PLEASANT VALLEY AVIATION – PROPERTY TAXES/LEASE PAYMENT: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to report that all 2009 property taxes on Power County Parcels #RPD0872-15 and #RPD0872-16 have now been paid in full. Following discussion with Power County Clerk Chris Steinlicht, the Commissioners agreed that the 2011 Airport Hanger lease payment in the amount of $2,570 remains due and owing and that the property taxes for 2010 will become due and payable in full on June 20th, 2011. Following further discussion, the Commissioners instructed Prosecutor Kline to contact any and all lending institutions that may hold the property as collateral against former occupant Brian Haynes to inquire whether a settlement can be reached, and this matter was tabled until April 11th, 2011.
U.S. SENATOR JIM RISCHE – STATUS REPORT: Jeremy Field of Senator Jim Rische’s Pocatello office appeared before the Commissioners to introduce himself to Commissioner Anderson and to offer any support or assistance Power County may need with regard to federal legislation and/or other issues of interest to Power County. Following discussion, Mr. Field did confirm that although Power County’s Federal PILT payment may be fully funded during fiscal years 2011 and 2012, reauthorization for funding after 2012 is highly questionable.
POWER COUNTY BUILDING & GROUNDS – USE POLICY: Following discussion, the Commissioners agreed that Power County should adopt a formal, written policy for use of County buildings and/or grounds by the public or community groups, and instructed Power County Prosecuting Attorney Randy Kline to prepare a proposed Use Policy. This matter was tabled until March 28th, 2011.
POWER COUNTY COMMISSIONER MINUTES: Moved by Commissioner Anderson, seconded by Commissioner Meadows, to approve the Power County Commissioner Minutes for January 10th, 21st, 24th, 31st and February 1st, 2011, as presented. Carried.
POWER COUNTY SEARCH & RESCUE – BUILDING NETWORK (QUOTE): Power County Sheriff Jim Jeffries appeared before the Commissioners to discuss the network cabling project at the Power County Search & Rescue building. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the quote prepared by Connective Computer Cabling to install interior ports that allow connection to the County’s network system for telephone and internet service, upon the condition that a hard copy of said quote is received by the Board of Power County Commissioners prior to installation. Carried.
POWER COUNTY JUVENILE PROBATION/BUILDING DEPARTMENT – COPY MACHINE LEASE: Power County Juvenile Probation Department Supervisor Connie Shepherd and Building Department Supervisor Robert Steinlicht appeared before the Commissioners to present a quote to renew the lease for their shared copier. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the quote submitted by Valley Office Systems to renew the copy machine lease, which includes an equipment upgrade to a Ricoh Afico MP 2050sp copier/printer/scanner in the amount of $89 per month. Carried.
FISCAL YEAR 2012 – BUDGET REQUEST HEARINGS: Following a review of the calendar, the Commissioner agreed to schedule fiscal year 2012 budget request hearings for June 1st, 2nd, 3rd, 6th and 7th, 2011.
POWER COUNTY INVESTMENT COMMITTEE: Power County Treasurer Deanna Curry and the Board of Commissioners then met as the Power County Investment Committee pursuant to Power County Resolution #2007-02. At the outset, Treasurer Curry presented a copy of the investment proposal submitted by Multi-Bank Securities, Inc. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the FHLB investment with Multi-Bank Securities, Inc., as presented in the amount of $250,000 with a maturity date of February 17th, 2016. Carried.
POWER COUNTY TRANSFER STATION/LANDFILL – ROCKLAND DUMPSTER SITE: Power County Transfer Station/Landfill Supervisor Craig Heward and Prosecuting Attorney Randy Kline appeared before the Commissioners to review the letter from Rockland Mayor Eddy Hansen dated February 9th, 2011, regarding the Memorandum of Understanding for the placement, operation and maintenance of a solid waste dumpster by Power County on a tract of land owned by the City of Rockland. The Commissioners then contacted Mayor Hansen by speaker telephone to discuss the matter further. Following discussion, the Commissioners and Mayor Hansen agreed that all issues of concern have been resolved and no formal written Memorandum of Understanding is necessary at this time.
POWER COUNTY TRANSFER STATION/LANDFILL – CITY OF AMERICAN FALLS (SPRING CLEAN UP): Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to discuss the City of American Falls’ Spring clean up. Following discussion, the Commissioners and Mr. Heward agreed that the City of American Falls should be billed for all “Spring clean up” loads actually hauled to the Power County Landfill rather than a flat fee.
HARDSHIP EXEMPTION APPLICATION (I.C. #63-711): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to deny the Hardship Exemption Application on Power County Parcels #RPA0272-00 and #RPA0268-01. Carried.
CLAIMS: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the claims as presented, amended and supplemented. Carried.

EXECUTIVE SESSION (I.C. #67-2345): Moved by Commissioner Anderson, seconded by Commissioner Meadows, to move into executive session pursuant to I.C. #67-2345, to consider records that are exempt from disclosure under Chapter 3, Title 9, Idaho Code, specifically indigent medical applications. Upon a call for the question, the following roll call vote was taken:

INDIGENT CASE #2011-13-I: Moved by Commissioner Anderson, seconded by Commissioner Meadows, to deny indigent medical application #2011-13-I, since applicant has other resources sufficient to pay the medical expenses incurred. Carried.
POWER COUNTY WATERWAYS – LIFE JACKET LOANER STATION: Marla Bailey and Joanne Duke of the Aaron and Jared Hale family appeared before the Commissioners to present their proposal to construct and maintain a life jacket loaner station at Power County’s West boat ramp, which would include a memorial stone to attract attention and encourage the use of life jackets. Also present were Power County Waterways Board Vice-Chairman Stan Gortsema, Search & Rescue Commander Ron Stilwell and Tom Hess from the Bureau of Reclamation. At the outset, Ms. Bailey reported that the project would be funded and manned totally via Idaho Department of Parks & Recreation grants and private donations. Following discussion, the Commissioners agreed that the Board of Power County Commissioners would offer whatever assistance necessary to complete the project and instructed Ms. Bailey to coordinate with the Power County Waterways Board and the Bureau of Reclamation to get the project completed. Following further discussion, Commander Stilwell agreed that the Power County Search & Rescue may be able to assist the Hale family with community outreach and dissemination of information if something could be scheduled in conjunction with the annual Salmon Barbeque on July 9th, 2011.
POWER COUNTY CLERK – CAPITALIZATION LIMITS: Following discussion with Power County Clerk Christine Steinlicht, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to establish $250 as Power County’s per item capitalization limit for inventory control and fixed asset management; but to continue Power County’s capitalization limit at $5,000 under Governmental Accounting Standards Statement No. 34. Carried.

Commissioner Ron Funk appeared via speaker telephone. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
COMMISSIONER AGENDA (I.C. #67-2343): Following a review of I.C. #67-2343, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to amend the February 28th, 2011, Commissioner Agenda to include the following items:
Fort Hall Indian Reservation/Shoshone-Bannock Tribes – Jurisdictional Issues (House Bill 111)
Power County Communications – Table Mountain Repeater Site
Power County Juvenile Probation – JABG Program (Parent Project)

FORT HALL INDIAN RESERVATION/SHOSHONE-BANNOCK TRIBES – JURISDICTION ISSUES (HOUSE BILL 111): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to discuss H0111, which would amend existing law relating to peace officers and provide for enforcement of State law by law enforcement officers of Federally recognized Indian Tribes. Prosecuting Attorney Kline reported that, although HB0111 was defeated by the Idaho House on a 34-35 vote, the bill may reappear during the 2011 Legislative Session. Following discussion, the Commissioners and Prosecuting Attorney Kline agreed to monitor H0111 and may refer this matter to Pat Sullivan at Reberger & Sullivan to assist Power County with strategic opposition planning if the bill reappears.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to report that he had reviewed the proposed Access Agreement & Easements for ingress and egress to the proposed Table Mountain Repeater site with landowners Brad and Lisa Ralphs, following which it was agreed that provision 3(A)(1) of the agreement should be amended to allow a width of twenty-five (25) feet rather than sixty (60) feet. Following discussion, the Commissioners agreed to table further consideration of this matter until later this Spring when weather conditions improve.
POWER COUNTY JUVENILE PROBATION – JUVENILE ACCOUNTABILITY BLOCK GRANT PROGRAM (PARENT PROJECT): Following discussion with Power County Juvenile Probation office supervisor Connie Shepherd, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve and execute the Juvenile Accountability Block Grant Program’s “Intent To Use Allocation” to operate a Parent Project program in Power County during Fiscal Year 2012 in the amount of $5,700, which requires matching funds of $633. Carried.
EXECUTIVE SESSION (I.C. #67-2345): Following discussion with Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to move into executive session pursuant to I.C. #67-2345, to consider records that are exempt from disclosure pursuant to Chapter 3, Title 9, Idaho Code, specifically wards under the supervision of the Power County Guardianship Board. Upon a call for the question, the following roll call vote was taken:

POWER COUNTY PROSECUTING ATTORNEY/COMMISSIONERS – SETTLEMENT AGREEMENT (MEDIATION): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to review, in detail, the provisions of the Settlement Agreement executed by the parties following mediation on January 24th, 2011. Following discussion, the Commissioners agreed that a Resolution should be adopted authorizing the Power County Auditor Chris Steinlicht to open Power County’s fiscal year 2011 budget to satisfy the budgetary provisions of said Settlement Agreement. Following further discussion, the Commissioner and Prosecuting Attorney Kline agreed to table further discussion of this matter until March 14th, 2011.
ONEIDA COUNTY – HIGHWAY #37 REBUILD (“THE NARROWS”): Commissioner Meadows and Commissioner Anderson reported that they had attended the public meeting hosted by Oneida County on Tuesday, February 15th, 2011, at the Rockland School to gain public input regarding the feasibility of highway improvements to that portion of Highway 37 commonly referred to as the narrows. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to issue a letter to the Oneida County Commissioners supporting the relocation and rebuilding of “the Narrows” portion of Highway 37. Carried.
PAYMENT IN LIEU OF TAXES (PILT) – FEDERAL FUNDING: The Commissioners then reviewed the notice from Ryan Yates of the National Association of Counties (NACO) that an amendment to Continuing Resolution (H.R. 1) has been offered that would cut federal PILT funding by 75% for fiscal years 2011 and 2012. Following discussion, the Commissioners agreed that, although the amendment was ultimately rejected by the U.S. House of Representatives, future PILT funding may be drastically reduced or even eliminated.
POWER COUNTY TRANSFER STATION/LANDFILL – CASCADE EARTH SCIENCE (CES): The Commissioners then discussed Cascade Earth Science’s assessment of Power County’s storm water control measures at the Power County Transfer Station/Landfill, which assessment was conducted to determine if existing practices are adequate. At the outset, Commissioner Anderson reported that CES has agreed that current practices are adequate; however, they would like Power County to voluntarily expand ground water and soil monitoring to include greenhouse gases. Commissioner Anderson further reported that the Idaho Department of Environmental Quality (DEQ) has scheduled groundwater and soil contamination monitoring training sessions in Boise on March 17th, 2011, and following discussion, the Commissioners agreed that Power County Transfer Station/Landfill Supervisor Craig Heward should attend those meetings to discuss Power County’s legal responsibilities for monitoring.
POWER COUNTY JAIL – IDAHO JAIL STANDARDS (JAIL MODIFICATIONS): Power County Sheriff Jim Jeffries appeared before the Commissioners by telephone to discuss the Idaho Sheriff Association’s on-going negotiations regarding modifications to Idaho Jail Standards. Following discussion, the Commissioners agreed to table further consideration of this matter until March 14th, 2011.
FISCAL YEAR 2012 BUDGET – PUBLIC HEARING (I.C. #63-802(A): Pursuant to I.C. #63-802(A), it was moved by Commissioner Meadows, seconded by Commissioner Funk, to schedule Power County’s fiscal year 2012 public budget hearing for Monday, August 22nd, 2011, at 5:00 p.m., in the Commissioners’ meeting room at the Power County Courthouse.
FISCAL YEAR 2012 BUDGET – CLERK’S TIMELINE: Power County Clerk Chris Steinlicht presented the Commissioners with the Clerk’s timeline to finalize Power County’s fiscal year 2012 budget.

INDIGENT CASE #2010-03-I: Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to accept Portneuf Medical Center’s offer to reimburse Power County the amount of $681.73 to fully and finally settle payment of all medical claims owing on Indigent Case #2010-03-I. Carried.
INDIGENT CASE #2011-06-I: Following a request for reconsideration, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve Indigent Case #2011-06-I. Carried.
POWER COUNTY INDIGENT SERVICES – UTILITY ASSISTANCE/PROJECT SHARE GUIDELINES (POWER COUNTY RESOLUTION #2011-01): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute Power County Resolution #2011-01 adopting Project Share guidelines for County utility assistance during periods of winter moratorium. Carried.
POWER COUNTY TREASURER – MONTHLY REPORT (I.C. #31-2113): Power County Treasurer Deanna Curry appeared before the Commissioners pursuant to I.C. #31-2113 to present her Statement of Treasurer’s Cash for the month ending January 31st, 2011.
POWER COUNTY TREASURER – SOLID WASTE DISPOSAL FEES (TAX BILLS): Power County Treasurer Deanna Curry appeared before the Commissioners to discuss residential and commercial solid waste disposal fees that are included on Power County’s annual tax bills. Following discussion, the Commissioners and Treasurer Curry agreed that a review and/or recalculation of all solid waste disposal fees should be accomplished prior to the 2013 tax drive.
POWER COUNTY TREASURER – ORDER FOR CANCELLATION OF TAXES: Following discussion with Power County Treasurer Deanna Curry, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Order for Cancellation of Taxes in the amount of $2,215.04 as presented. Carried.
BOARD OF EQUALIZATION (I.C. #63-501): The Board of Commissioners then met as the Power County Board of Equalization pursuant to I.C. #63-501. There being no business to come before the Board, the Power County Board of Equalization recessed until March 28th, 2011.

The Board of Power County Commissioners met in special session on Tuesday, March 1st, 2011. Present were Commissioners Vicki Meadows, Chairman, and Delane Anderson. Also present was Power County Clerk Christine Steinlicht.
POWER COUNTY WATERWAYS – FISCAL YEAR 2011 FUNDING: The following individuals attended the joint meeting of the Power County Waterways Board and Power County Board of Commissioners to review revenue and funding for Power County’s 2011 fiscal year:

Following discussion, it was agreed that the Power County Commissioners and Waterways Board will submit a joint letter to the Bannock County Commissioners and Waterways Board requesting assistance with Power County’s immediate and long-term waterways and boating safety needs, including, in no particular order, the following:

• To have in reserve several new or rebuilt docks for emergency purposes
• Upgrade several Snake River access ramps with rock filler
• Upgrade and expand the launch area and ramp at the West reservoir access
• Purchase ComGear communication equipment for Search & Rescue Dive Team
• Purchase a RAM portable tank air fill station for Search & Rescue Dive Team
• Purchase new tool sets for the Waterways maintenance vehicle
Chairman Ron Anderson reported that the Power County Waterways Board will continue to hold monthly meetings the first Monday of each month at the Courthouse Annex.

The Board of Power County Commissioners met in special session on Wednesday, March 2nd, 2011. Present were Commissioners Vicki Meadows, Chairman, and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
POWER COUNTY PLANNING & ZONING – ROCKLAND WIND FARM (RIDGELINE ENERGY, LLC): Power County Planning & Zoning Attorney Randy Kline appeared before the Commissioners to discuss the Rockland Wind Farm, which is being developed by Ridgeline Energy, LLC. Also present were Power County Planning & Zoning Administrator Robert Steinlicht and Jay Williams of Ridgeline Energy, LLC. Upon a unanimous recommendation from the Power County Planning & Zoning Board, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve and execute the Development Agreement between Power County and Ridgeline Energy, LLC, as presented. Carried.
