COMMISSIONER MINUTES
The Board of Power County Commissioners met in regular session on Monday, January 10th, 2011. Present were Commissioners Vicki Meadows, Chairman, and Ron Funk. Also present were Power County Clerk Christine Steinlicht and Commissioner-Elect Delane Anderson.
COMMISSIONER MINUTES: Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Commissioner Minutes for December 6th, 13th and 27th, 2010, as presented. Carried.

POWER COUNTY ELECTED OFFICIALS – OATH OF OFFICE: Power County Commissioner Ron Funk administered the Oath of Office to the following duly elected Power County officials:

The Board of Power County Commissioners reconvened at 9:30 a.m. Present were Commissioners Vicki Meadows, Ron Funk and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
COMMISSIONER CHAIRMAN: Moved by Commissioner Anderson, seconded by Commissioner Funk, to reappoint Commissioner Vicki Meadows to serve as chairman of the Power County Commission until January, 2013. Carried.
COMMISSIONER APPOINTMENTS: The Commissioners then agreed on which County Departments and boards each would oversee or act as liaison with during calendar years 2011 and 2012.
POWER COUNTY COMMISSIONERS – NOTICE OF MEETINGS (I.C. #67-2343(1): Following a review of I.C. #67-2343(1), it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Notice of Commissioner Meetings for 2011 prepared by Power County Clerk Chris Steinlicht, and to post said Notice in a prominent place at the Power County Courthouse and on the Power County Website. Carried.

2011 IDAHO LEGISLATIVE SESSION: The Power County elected officials and department heads discussed issues of legislation pertinent to Power County that may be introduced during 2011 Legislative Session, including the Idaho Association of Commerce & Industry (IACI) proposed legislation to eliminate personal property from taxation. Following discussion, the elected officials agreed to discuss these legislative issues further at the Idaho Association of Counties’ Mid-Winter Conference which begins February 7th, 2011.
FISCAL YEAR 2012 BUDGET: The Commissioners reported to the Power County elected officials and department heads regarding their Monday, January 3rd, 2011, meeting with the Idaho Legislative District #27 Delegation, at which they discussed future legislative issues and economic concerns that may negatively impact Power County’s Fiscal Year 2012 budget. Following discussion, the Commissioners suggested that all elected officials and department heads practice due diligence when submitting budget requests for fiscal year 2012.
POWER COUNTY EMPLOYEE MEDICAL BENEIT PLAN – GEM PLAN: The Power County elected officials and department heads then discussed the Power County employee medical benefit plan through the Gem Plan. Commissioner Meadows reported that the Gem Plan Board of Trustees has suggested that no changes be made to Power County’s benefit plan at this time.
EMPLOYEE ACCRUAL REGISTER – VACATION/COMPENSATORY TIME CARRY-OVER: The Commissioners reviewed the Power County Accrual Register showing vacation and compensatory time being carried over to calendar year 2011 by each County employee. Following discussion and a review of Sections VIIIB(5), VIIIC(1)(d) and VIIIC(2)(e) of the Power County Personnel Manual, the Commissioners agreed to grant all Power County employees an additional thirty (30) days to use excess vacation hours to avoid annual benefit reductions.
GERALD FEHRINGER YOUTH CENTER – OUTDOOR SIGN: Jennifer Rupp and Mary Annen of the Gerald Fehringer Youth Center appeared before the Commissioners to further discuss the placing of a larger outdoor sign at the Power County Courthouse Annex to clearly and publicly identify the location and hours of operation for the Youth Center. Following discussion, Ms. Rupp and Ms. Annen agreed to obtain quotes if and when the Youth Center Board determines that a new sign is necessary.

SHOSHONE-BANNOCK TRIBES – MINORITY COMMUNICATIONS BOARD: Following a review of the letter dated November 17th, 2010, from the Shoshone-Bannock Tribes inviting Power County to designate an individual to serve on the Tribe’s Minority Communications Board, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to appoint Ken Estep as Power County’s representative to the Shoshone-Bannock Tribes Minority Communications Board, with the understanding that the appointment is made based upon Power County’s willingness to cooperate, and not intended to cede jurisdiction in any way. Carried.
HUMAN RELATIONS ADVISORY COMMITTEE: Commissioner Anderson reported that the Power County Human Relations Advisory Committee, which was established pursuant to Ordinance #89-03 and is codified in Chapter 3, Title 2, of the Power County Code, is a defunct committee with no activity since January, 1990. Following discussion, the Commissioners agreed to refer this matter to Power County Prosecuting Attorney Randy Kline, with instructions that an ordinance be prepared to repeal Power County Ordinance #89-03 and dissolve the Human Relations Advisory Committee. This matter was tabled until February 14th, 2011.
POWER COUNTY LANDFILL – CASCADE EARTH SCIENCE (CES): George Spinner of Cascade Earth Sciences and Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to review CES’s revised proposal for storm water pollution prevention planning and mandatory greenhouse gas reporting at the landfill, at a total estimated project cost of $10,100. Mr. Spinner then presented the Commissioners with a copy of CES’s proposal for a study to place a final cover at the Power County Landfill, at a total estimated project cost of $30,000. Following discussion, the Commissioners agreed that they would need additional time to review the proposals and this matter was tabled until January 21st, 2011.
POWER COUNTY TRANSFER STATION/LANDFILL – ROCKLAND DUMPSTER SITE: Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to discuss Power County’s Rockland dumpster site, which is situated on property owned by the City of Rockland. Following discussion, the Commissioners and Prosecuting Attorney Kline agreed that Power County and the City of Rockland should enter into a formal, written agreement for Power County’s use of the property and this matter was tabled until February 14th, 2011.
LANCE FUNK D/B/A PLEASANT VALLEY AVIATION – DELINQUENT TAXES/LEASE AGREEMENT: The Commissioner reviewed the letter from Prosecuting Attorney Kline to Lance Funk d/b/a Pleasant Valley Aviation dated January 4th, 2011 demanding tax payment in full and production of purchase documents on Power County Parcel #RPD0872-15. At the outset, Prosecutor Kline reported that Mr. Funk is interested in negotiating a long-term lease; however, no purchase documents have been provided to date. Also present was Power County Treasurer Deanna Curry, who reported that a property tax payment in the amount of $1,605.68 was received by her office on December 20th, 2010, and applied to the 2009 taxes owing, leaving a balance of $766.16. Following discussion, the Commissioners agreed to table further consideration of this matter until February 14th, 2011.
POWER COUNTY GUARDIANSHIP BOARD: Commissioner Funk then reported that the Power County Guardianship Board has determined that its courtesy supervision of a Bannock County ward has been unduly burdensome and should be transferred back to the Bannock County where the subject resides. Prosecuting Attorney Kline reported that the Bannock County Guardianship Board has refused to accept the supervision transfer; however, Mr. Kline will continue to investigate all available options to return supervision of this ward to Bannock County. The Commissioners agreed to table further discussion of this matter until January 31st, 2011.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Following discussion with Power County Prosecuting Attorney Randy Kline and Power County Highway District Commissioner Gilbert Hofmeister, the Commissioners agreed that any easement with private landowners to access the Table Mountain Repeater Site should be restricted to approximately 20 feet and should allow ingress and egress to the Power County Highway District to perform limited and minor road maintenance when necessary.

INDIGENT CASE #2011-10-I: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to deny indigent medical application #2011-10-I, since applicant is not a resident of Power County as defined by I.C. #31-3502(12), since there are other resources sufficient to pay the medical expenses incurred as provided by I.C. #31-3502(23), and since the application was processed as incomplete under I.C. #31-3505A(2). Carried.
ENHANCED 911 SERVICES – DIRECT COMMUNICATION: Brigham Griffin of Direct Communications appeared before the Commissioners to discuss Power County’s current enhanced 911 system and to present a proposal to upgrade the system to a redundancy 911 model, which would increase the number of 911 calls that could be received by the Power County Dispatch Center, especially from the more remote areas of Power County, i.e. Rockland and Arbon Valley, and would require Power County to purchase additional 911 circuits. Also present were Power County Sheriff Jim Jeffries and Deputy Sheriff Kevin Ostler, who reported that Power County’s current E-911 system allows up to three 911 calls at any one time and is at maximum capacity for a single on-duty dispatcher to handle. Following discussion, the Commissioners suggested that Mr. Griffin and Sheriff Jeffries collaborate on a joint proposal to upgrade Power County’s enhanced 911 if that is deemed necessary.
POWER COUNTY JAIL – IDAHO JAIL STANDARDS (JAIL MODIFICATIONS): Power County Sheriff Jim Jeffries and Deputy Sheriff Kevin Ostler appeared before the Commissioners to review the Jail Standards Committee Minutes dated December 8th, 2010, regarding modifications to Idaho Jail Standards. Following discussion, the Commissioners agreed that since negotiations for jail standards are on-going, further consideration of this matter will be tabled until February 28th, 2011.
POWER COUNTY WATERWAYS – MARINE PATROL GRANT: Power County Sheriff Jim Jeffries, Deputy Sheriff Kevin Ostler and Marine Deputy Robert Williams appeared before the Commissioners to discuss Power County’s marine patrol program for the 2011 boating season. At the outset, Clerk Steinlicht reported that since the close out of Fiscal Year 2010 on September 30th, Power County has received $12,573 from the Idaho Department of Parks & Recreation for 2010 boat registration fees. The Commissioners and Sheriff Jeffries then reviewed the report from Bannock County Waterways detailing the contributions to Power County during 2008, 2009 and 2010. Sheriff Jeffries then reported that he had received notice from the Idaho Department of Parks & Recreation that the statewide RBS grant allocations will be reduced over last year due to decreased Federal Coast Guard funding; accordingly, the Commissioners and Sheriff Jeffries agreed to table further consideration of this matter until April 11th, 2011.
GRADUATION EQUIVILENCE DIPLOMA (GED) PROGRAM (ADULT SPANISH) – COMMUNITY EDUCATION FOUNDATION: Rudy Pena and Katy Ramirez appeared before the Commissioners to discuss the adult Spanish GED program in Power County. At the outset, Mr. Pena presented the Commissioners with statistical information from the 2010 calendar year, i.e. enrollment, graduates, etc. Following discussion and the opportunity for input from many of the GED students and graduates, the Commissioners agreed that Power County will continue to fund the adult Spanish GED program until further notice.
POCATELLO MUNICIPAL AIRPORT – REGIONAL DEVELOPMENT BOARD: Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to appoint Power County Building Administrator Robert Steinlicht to serve as Power County’s representative to the Pocatello Municipal Airport’s Regional Development Board, which Board oversee economic development opportunities at the Pocatello Municipal Airport in Eastern Power County. Carried.
IDAHO CAPITAL CRIMES DEFENSE BOARD – BOARD MEMBER BALLOT (AT-LARGE): Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Meadows, to cast Power County’s vote for Twin Falls County Commissioner George Urie to fill the at-large member position on the Idaho Capital Crimes Defense Board. Carried.
POWER COUNTY TREASURER – ORDER FOR CANCELLATION OF TAXES: Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Order for Cancellation of Taxes in the amount of $1,130.48 as presented. Carried.

The Board of Power County Commissioners met in special session on Friday, January 21st, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
2011 LEGISLATIVE SESSION – REBERGER & SULLIVER (LETTER OF AGREEMENT): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Letter of Agreement with Reberger & Sullivan to contract for public policy services involving State legislative strategic advice, planning and representation during the 2011 Legislative Session. Carried.
POWER COUNTY TRANSFER STATION/LANDFILL – CASCADE EARTH SCIENCES (CES): Commissioner Anderson reported that he and Power County Transfer Station/Landfill Supervisor Craig Heward have reviewed CES’s revised proposal for storm water pollution prevention planning and mandatory greenhouse gas reporting with Steven Pew of the Southeastern District Health Department. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve and execute the letter of agreement accepting “Task 1” of CES’s proposal in the amount of $5,100, to conduct an assessment of Power County’s storm water control measures to determine if existing practices are adequate. Carried. Commissioner Anderson reported that the CES’s report should be available for review on February 28th, 2011, and this matter was tabled until that time.
POWER COUNTY SHERIFF – IDAHO DEPARTMENT OF PARKS & RECREATION (JET BOAT GRANT): Power County Sheriff Jim Jeffries, Marine Patrol Deputy Robert Williams and Chief Deputy Sheriff Jackie Morris appeared before the Commissioners to report that Power County may qualify for funding under an Idaho Department of Parks & Recreation grant to purchase a new jet boat. Deputy Williams further reported that he has obtained a quote for the purchase of a Thunder Jet Boat and trailer in the approximate amount of $28,000, and that Power County’s matching funds for the grant would be limited to the following:
-- $13,293 cash match from the sale of Power County’s 2001 AHQ open bow propeller boat and trailer to Valley County.
-- $2,994 in-kind match to transfer the existing equipment from the 2001 AHQ boat to the new Thunder Jet boat.
Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to authorize Sheriff Jeffries to proceed with the Idaho Department of Parks & Recreation Grant as presented, upon the condition that Valley County commit, in writing, to purchase Power County’s 2001 AHQ boat and trailer for $13,293. Carried.
POWER COUNTY WATERWAYS – POWER COUNTY SHERIFF (BOAT REGISTRATION FEES): Power County Search & Rescue President Ron Stilwell appeared before the Commissioners with Power County Waterways Board Chairman Ron Anderson and Power County Sheriff Jim Jeffries to discuss contributions to Power County from Bannock County’s boat registration fees. At the outset, Mr. Stilwell reported that the first set of ComGear equipment has been purchased and delivered; however, Search & Rescue intends to continue to seek funding for a second set, including a request for funding from Bannock County Waterways Board. Following discussion, the Commissioners agreed that the Power County Waterways Board, Commissioners and Sheriff should coordinate and prioritize a list of Power County’s funding requests to Bannock County, and agreed to conduct a joint meeting on Tuesday, February 1st, 2011, at 12:00 noon to discuss the matter further.
POWER COUNTY SEARCH & RESCUE – BUILDING NETWORK: Power County Search & Rescue President Ron Stilwell appeared before the Commissioners to report that the office area inside the Search & Rescue Building is now complete and needs only interior ports installed to allow connection to the County’s network system for telephone and internet service. Following discussion, Sheriff Jeffries agreed to refer this matter to Deputy Sheriff Kevin Ostler to obtain a quote from Connective Computer Cabling and/or Bryce Harris to install network ports, and this matter was tabled until February 14th, 2011.

The Board of Power County Commissioners met in regular session on Monday, January 31st, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk and Delane Anderson. Also present was Power County Clerk Christine Steinlicht.
COMMISSIONER AGENDA (I.C. #67-2343): Following a review of I.C. #67-2343, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to amend the January 31st, 2011, Commissioner Agenda to include the following items:

ECONOMIC DEVELOPMENT – RIDGELINE ENERGY (WIND PROJECT): Commissioner Anderson reported that Ridgeline Energy has scheduled a landowners meeting at the American Falls Library on Tuesday, February 22nd, 2011, to discuss the wind turbine project in Power County. Commissioner Anderson further reported that the contractor for the Ridgeline Energy project, Wanzek Construction, intends to hire approximately 150 workers locally and will be hosting a jobs fair on Wednesday, February 23rd, 2011, from 9:00 a.m. until 5:00 p.m. at the Power County Courthouse Annex Conference Room.
POWER COUNTY PROSECUTING ATTORNEY/COMMISSIONERS – MEDIATION: Commissioner Meadows announced that on January 24th, 2011, the Power County Commissioners and Power County Prosecuting Attorney met in mediation and were able, in good faith, to resolve their differences to the mutual satisfaction of the parties; accordingly, a written mediation agreement is being prepared for the Commissioners and Mr. Kline’s consideration and this matter was tabled until February 14th, 2011.
EASTERN IDAHO STATE FAIR – ANNUAL BUDGET MEETING: Commissioner Funk reported that on January 28th, 2011, he attended the annual budget hearing for the Eastern Idaho State Fair in Blackfoot, Idaho. Commissioner Funk further reported that the “worst case scenario” projects a revenue shortfall of approximately $92,000 for the 2011 Eastern Idaho State Fair, with Power County’s contribution being reduced due to stagnant population and market value. Commissioner Funk further reported that several of the Eastern Idaho State Fair buildings are in need of repair or replacement. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Eastern Idaho State Fair’s annual budget report as presented. Carried.
POWER COUNTY WATERWAYS BOARD: Moved by Commissioner Meadows, seconded by Commissioner Funk, to reappoint Ron Anderson to serve an additional term of three (3) years on the Power County Waterways Board (January, 2014).
POWER COUNTY WEED BOARD: Moved by Commissioner Meadows, seconded by Commissioner Funk, to reappoint Burt Fehringer, Bill Schatz and Danielle Gunn each to serve an additional term of two (2) years on the Power County Weed Board, and to appoint Richard Call to serve a term of two (2) years (January, 2013).
POWER COUNTY SNOWMOBILE BOARD: Commissioner Anderson reported that Ron Morris and Linda Morris have resigned their positions on the Power County Snowmobile Board effective immediately. Following discussion, it was moved by Commissioner Anderson, seconded by Commissioner Meadows, to appoint Seth Lusk to serve a term of three (3) years (January, 2014) on the Power County Snowmobile Board, and to appoint Brian Payne (January, 2013) and Jaren Haskins (January, 2012), to fill the vacant positions. Carried.
POWER COUNTY TRANSFER STATION/LANDFILL – ROCKLAND DUMPSTER SITE: Sandra Bowman of the Power County Prosecuting Attorney’s office appeared before the Commissioners to present a draft Memorandum of Understanding for the placement, operation and maintenance of a solid waste dumpster by Power County on a tract of land owned by the City of Rockland. Ms. Bowman reported that copies of the draft MOU have also been provided to the City of Rockland and Power County Transfer Station/Landfill Supervisor Craig Heward. Following discussion, the Commissioners agreed to table further consideration of this matter until February 14th, 2011.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Sandra Bowman of the Power County Prosecuting Attorney’s office appeared before the Commissioner to present draft copies of the following documents, which would grant Power County ownership of and access to the Table Mountain Repeater:
-- Agreement to Convey Property by Deed between Power County and Vernon and Elaine Miller
-- Access Agreement & Easement between Power County and Vernon and Elaine Miller
-- Access Agreement & Easement between Power County and Brad and Lisa Ralphs
Ms. Bowman reported that copies of the proposed documents have been or will be provided to all interested parties for their review and consideration. Following discussion, the Commissioners agreed to table further consideration of this matter until later this Spring when weather conditions improve.
HUMAN RELATIONS ADVISORY COMMITTEE – POWER COUNTY ORDINANCE #2011-01: Sandra Bowman of the Power County Prosecuting Attorney’s office appeared before the Commissioners to present a draft copy of Power County Ordinance #2011-01, which is an ordinance to disband and terminate the Human Relations Advisory Committee that was established under Power County Ordinance #89-03. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to schedule public hearing on proposed Power County Ordinance #2011-01 for Monday, February 14th, 2011, at 9:00 a.m., and to properly publish notice of public hearing and proposed ordinance in the February 9th, 2011, edition of The Power County Press. Carried.
POWER SOIL CONSERVATION DISTRICT – ANNUAL REPORT: Power County Soil Conservation District Board members Roger Whitnah, Brett Leyshon and Ivan Permann appeared before the Commissioners with their Administrative Assistant Pegi Long, to present the District’s Annual Report and five-year resource conservation plan. Mr. Whitnah then requested that the Commissioners submit their letter of intent to provide the Power Soil Conservation District with a contribution from Power County’s fiscal year 2012 budget. Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Meadows, to submit a letter of intent to allocate $6,500 to the Power County Soil Conservation District from the County’s fiscal year 2012 budget. Carried.
POWER COUNTY DRUG COURT: Power County Magistrate Judge Paul Laggis appeared before the Commissioners with Sixth District Trial Court Administrator Suzanne Johnson, Sixth District Problem Solving Coordinator Matt English and Sixth District Drug Court Coordinator Deanna Smith to report that all Sixth District Drug Court funds have been exhausted and to discuss continued funding of the Power County Misdemeanor Drug Court. Following discussion, the Commissioners and Judge Laggis agreed that Ms. Smith’s services to Power County, in the amount of $400 per month, shall be paid first from the monthly drug court participant fees collected by Ms. Smith, and the balance, if any, from Power County’s interlock monitoring device fund.
POWER COUNTY CLERK – QUARTERLY FINANCIAL REPORT (I.C. #31-1611): Power County Clerk Christine Steinlicht appeared before the Commissioners pursuant to I.C. #31-1611 to present the Clerk’s quarterly financial reports for the period ending December 31st, 2010.
POWER COUNTY CLERK/TREASURER – JOINT QUARTERLY REPORT (I.C. #31-2306): Power County Clerk Christine Steinlicht and Power County Treasurer Deanna Curry appeared before the Commissioners pursuant to I.C. #31-2306 to present their joint quarterly financial report for the period ending December 31st, 2010.
POWER COUNTY TREASURER – MONTHLY REPORT (I.C. #31-2113): Power County Treasurer Deanna Curry appeared before the Commissioners pursuant to I.C. #31-2113, to present her statement of treasurer’s cash for the month ending December 31st, 2010.
POWER COUNTY TREASURER – ORDER FOR CANCELLATION OF TAXES: Following discussion with Power County Treasurer Deanna Curry and Power County Chief Deputy Assessor Mary Annen, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Order for Cancellation of Taxes in the amount of $3,641.72 as presented. Carried.
POWER COUNTY TREASURER – LOCAL GOVERNMENT INVESTMENT POOL (CONTACT CHANGE): Following discussion with Power County Treasurer Deanna Curry, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the State of Idaho Local Government Investment Pool Contact Change Form as presented. Carried.
POWER COUNTY TREASURER – STAFFING ISSUES: Power County Treasurer Deanna Curry appeared before the Commissioners to discuss staffing issues within the Power County Treasurer’s Office. At the outset, Treasurer Curry reported that Teri Kendall has been appointed to serve as Chief Deputy Treasurer, leaving a vacancy in the full-time Deputy Treasurer position. Following discussion, the Commissioners and Treasurer Curry agreed that the vacant Deputy Treasurer position will be filled on a part-time or seasonal basis rather than full-time.
POWER COUNTY HIGHWAY DISTRICT – ASSIGNMENT OF LEASE (ARBON POST OFFICE): Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Lease Assignment & Assumption for the Arbon Post Office property from Power County to the Power County Highway District. Carried.
JUNIOR COLLEGE – CERTIFICATES OF RESIDENCY: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Certificates of Residency submitted by the College of Southern Idaho. Carried.
BOARD OF EQUALIZATION (I.C. #63-501): The Board of Power County Commissioners then met as the Power County Board of Equalization pursuant to I.C. #63-711. Power County Chief Deputy Assessor Mary Annen appeared before the Board pursuant to I.C. #63-301 and #63-311 to present the 2010 Final Occupancy and Missed Property Rolls. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the 2010 Subsequent Property Rolls as presented and to sustain the values of Power County Assessor Douglas Glascock. Carried. There being no further business to come before the Board, the Power County Board of Equalization recessed until February 28th, 2011.
HARDSHIP EXEMPTION APPLICATION (I.C. #63-711): Applicant appeared before the Board of Power County Commissioners to present his Hardship Exemption Application on Power County Parcels #RPA0272-00 and #RPA0268-01. Following discussion, the Commissioners agreed to take this matter under advisement until February 14th, 2011.
POWER COUNTY GUARDIANSHIP BOARD: Power County Guardianship Board Chairman Donna Thornton appeared before the Commissioners to report that David Cox has resigned his position on the Power County Guardianship Board, effective immediately. Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Meadows, to reappoint Jon Beake, Debbie Swanson, Jeff Barnes, Elna Neu, Debbie Crompton, Jim Morse and Donna Thornton each to serve an additional term of two (2) years on the Power County Guardianship Board (January, 2013) and to appoint Denise Ralphs (January, 2012) and Marie Sorensen (January, 2012) to fill the remaining vacant positions. Carried.
EXECUTIVE SESSION (I.C. #67-2345) – POWER COUNTY GUARDIANSHIP BOARD: At the request of Power County Guardianship Board Chairman Donna Thornton, it was moved by Commissioner Funk, seconded by Commissioner Anderson, to move into executive session pursuant to I.C. #67-2345, to consider records that are exempt from disclosure pursuant to Chapter 3, Title 9, Idaho Code, specifically wards under supervision of the Power County Guardianship Board. Upon a call for the question, the following roll call vote was taken:

POWER COUNTY ASSESSOR – CIRCUIT BREAKER APPLICATION PROCESS: Power County Deputy Assessor Elna Neu appeared before the Commissioners to discuss the State’s Property Tax Reduction Program (Circuit Breaker), which reduces property taxes for qualified applicants. Deputy Assessor Neu then reported that the Power County Assessor’s office is currently conducting public outreach and will be accepting applications until April 15th, 2011.
CLAIMS: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the claims as presented, amended and supplemented. Carried.

COMMISSIONER MINUTES
The Board of Power County Commissioners met in special session on Tuesday, February 1st, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk, and Delane Anderson. Also present was Power County Clerk Christine Steinlicht.
POWER COUNTY WATERWAYS – FISCAL YEAR 2011 FUNDING: The following individuals attended the joint meeting of the Power County Waterways Board and Power County Board of Commissioners to review revenue and funding for Power County’s 2011 fiscal year:

Following a video presentation, Commissioner Anderson announced that Title 31, Chapter 22 of the Idaho Code sets the chain of command for Search & Rescue/Marine Patrol duties; but funding marine patrol services begins with the Board of Commissioners, who work in conjunction with the Power County Waterways Board to set annual budgets based on revenue projections from any and all sources, including Bannock County’s Waterways contributions. Commissioner Anderson further reported that, given the on-going revenue shortfalls and the need to coordinate resources for the betterment of Power County and its citizens, the Board of Commissioners must require strict compliance with the chain of command. Following the opportunity for open discussion, the Waterways Board, Sheriff Jeffries and Commander Stilwell agreed to coordinate and prioritize a list of projects that could be appropriately funded with boat registration fees during fiscal year 2011, which list will then be referred to the Board of Power County Commissioners who will work directly through the Board of Bannock County Commissioners for appropriation requests. Following further discussion, the Waterways Board and Sheriff Jeffries agreed to meet jointly the first Tuesday of each month throughout the entire boating season, beginning March 1st, 2011, to re-evaluate needs and review budget balances. This matter was tabled by the Board of Commissioners until March 14th, 2011.
