COMMISSIONER MINUTES
The Board of Power County Commissioners met in special session on Thursday, July 7th, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk and Delane Anderson. Also present was Power County Clerk Christine Steinlicht.
COMMISSIONER AGENDA (I.C. #67-2343): Following a review of I.C. #67-2343, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to amend the July 7th, 2011, Commissioner Agenda to include the following items:
Power County Historical Society – Record Retention (I.C. #31-871)
Destruction of Records

POWER COUNTY HISTORICAL SOCIETY BOARD – RECORD RETENTION DESTRUCTION (I.C. #31-871): Commissioner Meadows reported that the Power County Historical Society Board has conducted an audit of their historical records and has determined that all medical records in their possession, which are specifically exempt from public disclosure as provided by I.C. #9-340(C)(13), should be immediately destroyed as provided by I.C. #31-871(d). Following discussion with Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to authorize the immediate destruction of any and all medical records currently in the possession of the Power County Historical Society, such disposition shall be under the direction and supervision of Power County Clerk Chris Steinlicht. Carried.
POWER COUNTY COMMISSIONER MINUTES: Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Meadows, to approve the Power County Commissioner Minutes for June 13th and 27th, 2011, as presented. Carried.
POWER COUNTY FISCAL YEAR 2012 – BUDGET WORK SESSION: The Board of Commissioners and Power County Clerk Chris Steinlicht then conducted a fiscal year 2012 budget work session to review and discuss the Clerk’s suggested budget of estimated expenditures, anticipated revenue from all sources and unexpended fund balances, which budget was presented to the Board of Power County Commissioners on June 27th, 2011. Following discussion, the Commissioners agreed to table further consideration of this matter until July 11th, 2011.
POWER COUNTY TRANSFER STATION & LANDFILL – DEMOLITION PIT: Following discussion, the Commissioners agreed to conduct an on-site inspection of the proposed demolition pit area of the Power County Landfill and this matter was tabled until July 25th, 2011.

COMMISSIONER MINUTES
The Board of Power County Commissioners met in regular session on Monday, July 11th, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
POWER COUNTY BUILDING & GROUNDS – 528 GIFFORD AVENUE: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to discuss Power County’s property located at 528 Gifford Avenue. Following a review of I.C. #31-808, the Commissioners and Prosecutor Kline agreed that the building situated on the real property located at 528 Gifford could be offered for sale at public auction, and that detailed specifications for removal of the structure should be prepared and published along with the notice of public auction. Prosecuting Attorney Kline agreed to prepare proposed specifications for the Commissioners review and this matter was tabled until July 25th, 2011.
FORT HALL INDIAN RESERVATION – JURISDICTION ISSUES (LAW ENFORCEMENT): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to discuss law enforcement and other jurisdictional issues within the common boundaries of the Fort Hall Indian Reservation and Power County. Following discussion, the Commissioners agreed to carefully monitor any and all Legislative attempts to amend existing law to allow enforcement officers of federally recognized Indian Tribes to enforce State Law.
GERALD FEHRINGER YOUTH CENTER – LEASE AGREEMENT: Following discussion with Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve and execute the Lease Agreement between Power County and American Falls Youth Ministry, Inc. d/b/a Gerald Fehringer Youth Center as presented for the period October 1st, 2011, through September 30th, 2012. Carried.
AMERICAN FALLS RURAL FIRE DISTRICT – EXTRICATION AGREEMENT: Following discussion with Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Agreement for Extrication Services between Power County and the American Falls Rural Fire District for extrication services during the period October 1st, 2011, through September 30th, 2012. Carried.
POWER COUNTY SHERIFF – JAIL MODIFICATION/REMODEL: Power County Sheriff Jim Jeffries appeared before the Commissioners to present a plan to modify and remodel specific areas of the Power County Jail facility in order to meet compliance with Idaho Jail Standards, along with a quote from BGM Builders in the amount of $65,305.00. Following discussion, the Commissioners agreed that an architect may need to be consulted prior to proceeding further and this matter was tabled until August 29th, 2011.
POWER COUNTY SHERIFF – TELMATE INMATE MANAGEMENT CORPORATION (TELECOMMUNICATIONS SYSTEM): Robert Foringer of Telmate Inmate Management Corporation appeared before the Commissioners with Power County Sheriff Jim Jeffries and Deputy Brad Ostler, to present a proposal to install a fully automated Kiosk for inmate management, at no cost to Power County, capable of relieving a number of different administrative burdens including:
• Visitation scheduling and telephone/video communications
• Inmate commissary balancing/auditing (debit MasterCard program)
• Security Control
Mr. Foringer then reported that Telmate will offer Power County a 35% commission on gross revenue of inmate telephone calls and voice mail. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to authorize Power County Sheriff Jim Jeffries to proceed with the implementation of a Telmate Inmate Management System as proposed, with one fully automated Kiosk. Carried.
CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS – PIONEER DAY ACTIVITIES (BICYCLE RACE/FUN RUN): Boyd Rowe of The Church of Jesus Christ of Latter-day Saints appeared before the Commissioners to present copies of the proposed routes for fun runs and bicycle races to be held in eastern Power County on Saturday, July 23rd, 2011, in conjunction with Pioneer Day activities. Mr. Rowe also presented copies of the trespass permits issued to the LDS Church by the Shoshone-Bannock Tribes and the J.R. Simplot Company, as well as a Certificate of Liability Insurance for all 2011 Pioneer Day activities. Also present was Power County Sheriff Jim Jeffries who agreed to provide safety officers at the appropriate State highway off-ramps. Following discussion, the Commissioners suggested that Mr. Boyd also contact the Power County Highway District to discuss their schedule for road maintenance on July 23rd, 2011.
POWER COUNTY TRANSFER STATION/LANDFILL – EQUIPMENT PURCHASE: Following discussion with Power County Transfer Station & Landfill Supervisor Craig Heward, the Commissioner agreed to table further consideration of this matter until July 25th, 2011.
POWER COUNTY TRANSFER STATION & LANDFILL – SOUTHERN IDAHO REGIONAL SOLID WASTE DISTRICT (DISPOSAL CONTRACT): Josh Bartlome and Stephanie Thompson from Southern Idaho Regional Solid Waste District appeared before the Commissioners with Power County Transfer Station & Landfill Supervisor Craig Heward to review their Contract with Power County, which is scheduled to expire on September 30th, 2011. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to contract with Southern Idaho Solid Waste, a regional solid waste disposal district existing pursuant to I.C. #31-4901, et. seq., for an additional five (5) year period beginning October 1st, 2011. Carried. Mr. Bartlome reported that the Southern Idaho Regional Solid Waste District Board will refer this matter to legal counsel for the preparation of a proposed Contract for the Commissioners review and this matter was tabled until August 22nd, 2011.
POWER COUNTY BUILDING & GROUNDS – PARKING LOTS/SIDEWALK REPAIRS: The Commissioners reviewed the estimates obtained from L&A Concrete and BGM Builders, Inc., to repair damage to the sidewalk and driveway approach on County property adjacent to the Power County Courthouse. Following discussion, it was moved by Commissioner Anderson, seconded by Commissioner Funk, to accept the quote submitted by BGM Builders, Inc., in the amount of $1,168. Carried. Following further discussion, the Commissioners agreed to obtain additional quotes for parking lot repairs and this matter was tabled until August 29th, 2011.
JUNIOR COLLEGE – CERTIFICATES OF RESIDENCY: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Certificates of Residency presented by the College of Southern Idaho. Carried.
ALCOHOL BEVERAGE LICENSES (I.C. #23-903): Commissioner Meadows announced that it was the date and time scheduled for consideration of a number of 2011-2012 alcohol beverage licenses. There being no public objection, it was moved by Commissioner Funk, seconded by Commissioner Anderson, to approve the following alcohol beverage licenses:
#1A. Stan or Floreen Thyberg d/b/a Idaho Unlimited for the sale of bottled or canned beer to be consumed on the premises.
#2A. George and Shirley Udy d/b/a Mr. Petrol’s Pantry for the sale of bottled or canned beer not to be consumed on the premises.
#3. Angela D. Davis d/b/a The Silver Horseshoe Bar, LLC, for the sale of draught and bottled or canned beer to be consumed on the premises and retail wine.
#3A. Fay LaRay Correll d/b/a Willow Bay Café for the sale of draught, bottled or canned beer to be consumed on the premises and not to be consumed on the premises.

POWER COUNTY MISDEMEANOR PROBATION – MISDEMEANOR PROBATION SERVICES AGREEMENT (FISCAL YEAR 2012): Nancy Cladis of Power County Adult Misdemeanor Probation, Inc. appeared before the Commissioners by speaker telephone to discuss renewal of the Misdemeanor Probation Services Agreement for fiscal year 2012. Following discussion, the Commissioners agreed to table further consideration of this matter until August 8th, 2011.
POWER COUNTY MISDEMEANOR PROBATION – BUILDING USE AGREEMENT (528 GIFFORD): Nancy Cladis of Power County Adult Misdemeanor Probation, Inc., appeared before the Commissioners by speaker telephone to discuss their occupancy of Power County’s property at 528 Gifford Avenue. Following discussion, the Commissioners and Ms. Cladis agreed that moving Power County Misdemeanor Probation Services to Power County’s facility at 569 Bannock Avenue (formerly Idaho Department of Health & Welfare), should be accomplished as soon as possible.
POWER COUNTY BOARD OF EQUALIZATION (I.C. #63-501): The Commissioners then met as the Power County Board of Equalization pursuant to I.C. #63-501. Also present were Power County Assessor Doug Glascock and Power County’s independent contract appraiser Richard Hartley.
Applicant Jeremiah Miller appeared before the Board of Equalization to dispute the Power County Assessor’s value on Parcel #RPA2005-18. Following a review of the application, testimony and exhibits presented, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to set market value of Parcel #RPA2005-18 at $225,000 ($30,000 for land/$195,000 buildings). Upon a request for a roll call vote, the following vote was taken:

Power County Deputy Assessor Donna Thornton then appeared before the Commissioners to present the Assessor’s report of Rural Subdivisions within Power County that have been allowed to maintain agricultural tax value pursuant to I.C. #63-602(k) until the initial improvement of building or infrastructure is commenced. Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Anderson, to approve and accept the Rural Subdivision/Agricultural Tax Value report as presented. Carried.
There being no further business to come before the Board of Equalization, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to adjourn the Power County Board of Equalization and to sustain all remaining market values set by Power County Assessor Douglas Glascock for the 2011 tax year. Carried.
EXECUTIVE SESSION (I.C. #67-2345): Moved by Commissioner Meadows, seconded by Commissioner Anderson, to move into executive session pursuant to I.C. #67-2345, to consider records that are exempt from disclosure under Chapter 3, Title 9, Idaho Code, specifically indigent medical applications. INDIGENT CASE #2011-29-I: Moved by Commissioner Meadows, seconded by Commissioner Funk, to deny indigent medical application #2011-29-I, since the proposed treatment does not meet the definition of “medically necessary” as defined in I.C. #31-3502(18). Carried.
EASTERN POWER COUNTY FIRE DISTRICT – WILDLAND URBAN INTERFACE FIRE CODE: Eastern Power County Fire District Board member Paul Westwood appeared before the Commissioners to discuss the Eastern Power County Fire District’s proposed Wildland Urban Interface Fire Code. At the outset, Power County Prosecuting Attorney Randy Kline reported that I.C. #31-1417 grants the sole authority and duty to establish and enforce fire codes to individual fire protection districts; accordingly, the Commissioners agreed to remove this matter as an agenda item and suggested that the Eastern Power County Fire District Board proceed with fire code enforcement as they and their constituents deem appropriate.
POWER COUNTY WEED DEPARTMENT – BUILDING IMPROVEMENTS: Power County Weed Department Supervisor Curtis Munk appeared before the Commissioners to present quotes from Quality Overhead Door and Western Wholesale Supply, Inc., to replace windows and doors at the Power County Weed Control shop. Following discussion, it was moved by Commissioner Anderson, seconded by Commissioner Funk, to approve and accept the quote submitted by Quality Overhead Door Company in the amount of $3,310 to install new windows, doors and overhead doors at Power County Weed Control shop. Carried.
FISCAL YEAR 2012 BUDGET – WORK SESSION: The Board of Commissioners and Power County Clerk Chris Steinlicht then conducted a fiscal year 2012 budget work session. Following discussion, the Commissioners agreed to table further consideration of this matter until July 22nd, 2011.

Carried.
FISCAL YEAR 2012 BUDGET – PUBLICATION: The Board of Commissioners then conducted a fiscal year 2012 budget work session to review expenditures, salary/benefit changes, capital purchases and fund transfers that should be incorporated into Power County’s fiscal year 2012 Budget. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to publish Notice of Public Hearing on Power County’s final proposed budget for fiscal year 2012 in the August 10th and 17th, 2011, editions of The Power County Press. Carried. Further consideration of this matter was tabled until the public budget hearing scheduled for August 22nd, 2011, at 5:00 p.m.

IDAHO DEPARTMENT OF JUVENILE CORRECTIONS – MEMORANDUM OF UNDERSTANDING (SUBSTANCE ABUSE): Idaho Department of Juvenile Corrections District Liaison Bill Lasley appeared before the Commissioners with Sixth District Juvenile Detention Facility Director Seth Scott to review the Memorandum of Agreement to support the Sixth District juvenile substance use disorder treatment committee, which is being established to manage the District’s substance abuse disorder funds. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Memorandum of Understanding between Bannock, Bear Lake, Caribou, Franklin, Oneida and Power Counties as presented. Carried.
POWER COUNTY TREASURER – TAX DEEDED PARCEL (PUBLIC AUCTION): The Board of Commissioners then attended a public auction conducted by Power County Treasurer Deanna Curry on the following parcel:

Following discussion with Treasurer Curry, the Commissioners instructed Prosecuting Attorney Kline to provide written notice to the previous owners that all personal items be removed from the premises immediately. Also present was Great Rift Business Development Director Kristen Jensen who reported that the Idaho Department of Environmental Quality may have funds available under the “Brownsfield Program” to assist Power County with a study to determine the particulate level of asbestos in and around the structure situated on Parcel #RPA0812-00. Following discussion, the Commissioners authorized Ms. Jensen to proceed with a “Brownsfield Program” application through the Department of Environmental Quality and this matter was tabled until August 8th, 2011, at 10:00 a.m.
POWER COUNTY TREASURER – MONTHLY REPORT (I.C. #31-2113): Power County Treasurer Deanna Curry appeared before the Commissioners to present her Statement of Treasurer’s Cash for the month ending June 30th, 2011. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Statement of Treasurer’s Cash as presented. Carried.
POWER COUNTY CLERK/TREASURER – JOINT QUARTERLY REPORT (I.C. #31-2306): Power County Clerk Christine Steinlicht and Power County Treasurer Deanna Curry appeared before the Commissioners to present their Joint Quarterly Report for the period ending June 30th, 2011. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Clerk/Treasurer Joint Quarterly Report as presented. Carried.
POWER COUNTY CLERK – QUARTERLY FINANCIAL REPORTS (I.C. #31-1611): Power County Clerk Christine Steinlicht appeared before the Commissioners to present her quarterly financial report for the period ending June 30th, 2011. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the Clerk’s quarterly financial report as presented. Carried.
U.S. DEPARTMENT OF ENERGY (EFFICIENCY AND CONSERVATION BLOCK GRANT): Doug Tanner of the Idaho Department of Energy appeared before the Commissioners via speaker telephone to discuss Section #5.2.5 of the Energy Efficiency & Conservation Block Grant (EECBG) Contract #CON00044 to “replace the existing pump with energy efficient pump at fairgrounds”. Following discussion, Mr. Tanner agreed to review the possibility of Power County obtaining a “waiver” and/or “Contract Amendment” to upgrade to a variable frequency drive rather than total pump replacement, and this matter was tabled until August 29th, 2011.
POWER COUNTY CLERK – PRECINCT BOUNDARIES (I.C. #34-301 & #34-307): Power County Clerk Christine Steinlicht appeared before the Commissioners to review I.C. #34-301 and #34-307 regarding the establishment and maintenance of election precincts by County Commissioners. POWER COUNTY SHERIFF – IDAHO EMERGENCY COMMUNICATIONS COMMISSION (IECC) GRANT: Following discussion with Power County Deputy Sheriff Kevin Ostler, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Idaho Emergency Communication Commission Grant Application for fiscal year 2012. Carried.
POWER COUNTY BUILDING & GROUNDS – SURPLUS PROPERTY (PUBLIC AUCTION – 528 GIFFORD): Following a review of I.C. #31-808 with Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to declare the structure situated upon Power County Parcel #RPA1021-00, as surplus personal property with a value in excess of $250, to be sold at public auction on August 22nd, 2011, at 9:30 a.m., with Notice of Public Auction and bid specifications to be published in the August 10th and 17th, 2011, editions of The Power County Press, said auction to take place at 528 Gifford Avenue, American Falls. Carried.
POWER COUNTY AMBULANCE DISTRICT: Moved by Commissioner Meadows, seconded by Commissioner Funk, to recess as Power County Board of Commissioners and reconvene as Power County Ambulance District Board. Carried.
AMBULANCE – WARRANTY/REPAIRS: Power County Ambulance District Director Di Jones appeared before the Commissioners to discuss the on-going and extensive mechanical problems with the 2007 Ford Ambulance (VIN #1FDWF37P77EA62226), which has been delivered to 20th Century Ford multiple times over the past two weeks for warranty repair, i.e. blown injectors, turbo issues, etc. Following discussion, the Commissioners suggested that the 2007 Ford Ambulance be used only as “second-line” emergency transportation until it can be replaced. The Commissioners agreed to discuss this matter further with Royce Barton d/b/a Rocky Mountain Ambulance Sales and this matter was tabled until August 8th, 2011.

There being no public objection, it was moved by Commissioner Funk, seconded by Commissioner Anderson, to approve the following alcohol beverage licenses:

U.S. SENATOR JIM RISCH – STATUS CONFERENCE: Jeremy Field of U. S. Senator Jim Risch’s Pocatello office appeared before the Commissioners to present his quarterly report on federal issues pertinent to Power County. Mr. Field reported that federal funding under the Secure Rural Schools Act, which requires that a portion of the revenues derived from National Forest lands be paid to States for use by the Counties in which the lands are situated for the benefit of public schools and roads, is on track to be either significantly reduced or eliminated by the U.S. Congress. Mr. Field then reminded the Commissioners that, although Power County’s Federal PILT payment may be fully funded through fiscal year 2012, reauthorization for continued funding after 2012 is questionable. Following discussion, Mr. Field suggested that all taxing entities within Power County who rely on Secure Rural School or PILT funds be mindful in regard to budgeting.
POWER COUNTY TRANSFER STATION/LANDFILL – EQUIPMENT PURCHASE: Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners with Darrell Simmons of Honnen Equipment to present quotes for the purchase of a new 2011 John Deere Industrial 624 K Loader and a new 2011 John Deere Industrial 644 K Loader for use at the Power County Transfer Station/Landfill. Following discussion, the Commissioners agreed to table further consideration of this matter until August 8th, 2011.
POWER COUNTY TRANSFER STATION/LANDFILL – EQUIPMENT PURCHASE: Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to present a quote from Tri-County Equipment Sales, LLC, for the purchase of a certified remanufactured Al-Jon ADV 500 Compactor for use at the Power County Transfer Station/Landfill. Following discussion, the Commissioners agreed to table further consideration of this matter until August 8th, 2011.
POWER COUNTY TRANSFER STATION/LANDFILL – DEMOLITION PIT: Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to report that Anderson Construction has completed the construction of a new demolition pit. Mr. Heward then reported that Snake River Surveyors, who was hired by Power County to cross-section the pit, is reporting that the pit is approximately 28,000 yards.
POWER COUNTY HOSPITAL DISTRICT – RURAL HEALTH CARE ACCESS PROGRAM GRANT (LETTER OF SUPPORT): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to issue a letter supporting Power County Hospital District’s grant application to the Rural Health Care Access Program to obtain educational funding for medical providers. Carried.
POWER COUNTY HOSPITAL DISTRICT – UNITED STATES DEPARTMENT OF AGRICULTURE (USDA) RURAL DEVELOPMENT GRANT (LETTER OF SUPPORT): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to issue a letter supporting Power County Hospital District’s grant application to USDA Rural Development for a new blood chemistry analyzer. Carried.

GRADUATION EQUIVILENCE DIPLOMA (GED) PROGRAM (ADULT SPANISH) – COMMUNITY EDUCATION FOUNDATION: Rudy Pena of the Power County Community Education Program appeared before the Commissioners to discuss the adult Spanish GED program in Power County. At the outset, Mr. Pena presented the Commissioners with statistical information from the Spring 2011 graduation, including the continuing education opportunities being pursued by many of the twenty-two graduates. Mr. Pena then expressed his desire to secure a facility where a classroom, computer lab and appropriate child care/learning center could be available each Saturday, which would greatly ease the burden upon those families seeking GED’s. Following discussion, the Commissioners agreed to investigate the possibility of Mr. Pena utilizing the Power County Courthouse Annex, including the Youth Center area of the building which houses a computer lab, as an Adult Spanish GED facility on Saturdays, and further consideration of this matter was tabled until August 8th, 2011.

VECTOR DISEASE CONTROL INTERNATIONAL – MOSQUITO ABATEMENT: Tim Bennett of Vector Disease Control International appeared before the Commissioners to present his Mosquito Surveillance and Control Report for Power County for June, 2011.
