COMMISSIONER MINUTES
The Board of Power County Commissioners met in regular session on Tuesday, October 11th, 2011. Present were Commissioners Vicki Meadows and Delane Anderson. Commissioner Ron Funk appeared via speaker telephone. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
COMMISSIONER AGENDA (I.C. #67-2343): Following a review of I.C. #67-2343, and good cause appearing therefore, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to amend the October 11th, 2011, Commissioner Agenda to include the following items:

EXECUTIVE SESSION (I.C. #67-2345): At the request of Great Rift Business Development Director Kristen Jensen, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to move into executive session pursuant to I.C. #67-2345 to consider preliminary negotiations involving matters of trade or commerce in which the governing body is in competition with governing bodies in other states or nations. Upon a call for the question, the following roll call vote was taken:

POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Following discussion with Power County’s Table Mountain Project Director Ken Estep, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve and execute a letter to the Idaho Department of Homeland Security requesting connectivity to the State of Idaho’s master site in Meridian, Idaho, which could be accomplished through a Motorola PTP 49600 connector link between Table Mountain and Paps Mountain. Carried.
POWER COUNTY SHERIFF – POWER COUNTY PERSONNEL MANUAL: Following discussion with Power County Sheriff Jim Jeffries, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to amend Section VIII(C)(3) of the Power County Personnel Manual to add the following additional language:
“Because the Sheriff’s Office must be staffed 24 hours per day, 365 days per year and most employees work a rotating shift, holiday compensation will be handled in the following manner:
• with regard to County recognized holidays, employees who work a shift on a holiday will receive their regular pay plus 8 hours of compensatory time.
• No compensation or compensatory time will be given to an employee who is on a regularly scheduled day off during a holiday.”

POWER COUNTY SHERIFF – SURPLUS COUNTY PROPERTY: Following discussion with Power County Sheriff Jim Jeffries, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to declare the following items as surplus County property, each with a value of less than $250, to be disposed of in accordance with Idaho Law as deemed appropriate by Power County Sheriff Jim Jeffries, to-wit:

POWER COUNTY WEED DEPARTMENT – CAPITAL PURCHASE: Following discussion, it was moved by Commissioner Funk, seconded by Commissioner Meadows, to approve the purchase of a 2008 Ford F250 Crew Cab Pickup, VIN #1FTSW21518EA24416, from the State of Idaho’s Federal Surplus Property Program in the amount of $13,750, to be paid from the Power County Weed Department’s fiscal year 2011 Capital Vehicle account. Carried.
POWER COUNTY TRANSFER STATION/LANDFILL – EQUIPMENT PURCHASE: Jim Betty of Western States Equipment appeared before the Commissioners to discuss the purchase of a compactor by the Power County Transfer Station/Landfill. At the outset, Commissioner Anderson reported that Western States Equipment has determined that Power County’s current compactor is unsafe to operate, cost prohibitive to repair, and may not be the optimum equipment for landfill uses. Mr. Betty then presented the Commissioners with a quote to purchase a new 963D Caterpillar Waste Handler in the amount of $287,806.48, which is designed with load, carry and compact applications that would handle Power County’s waste much more effectively and efficiently without the need for any additional equipment. Following discussion, the Commissioners requested that Mr. Betty investigate the availability of rebuilt and/or used Caterpillar Waste Handlers and further consideration of this matter was tabled until Monday, October 24th, 2011.
EXECUTIVE SESSION (I.C. #67-2345): Moved by Commissioner Meadows, seconded by Commissioner Anderson, to move into executive session pursuant to I.C. #67-2345, to consider records that are exempt from disclosure under Chapter 3, Title 9, Idaho Code, specifically indigent medical applications. INDIGENT CASE #2011-16-I: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to deny indigent medical application #2011-16-I, since no applications were filed in a timely manner as provided by I.C. #31-3503(5)(a)(1). Carried.
INDIGENT CASE #2012-09-I: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve indigent medical application #2012-09-I. Carried.
INDIGENT CASE #2012-14-I: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to deny indigent medical application #2012-14-I, since applicant has other resources sufficient to pay the medical expenses incurred as provided by I.C. #31-3502. Carried.
INDIGENT CASE #2012-17-I: Moved by Commissioner Meadows, seconded by Commissioner Anderson, to deny indigent medical application #2012-17-I, since applicant is not a resident of Power County or the State of Idaho as provided by I.C. #31-3505(22). Carried.
POWER COUNTY INDIGENT SERVICES – ACCOUNTS RECEIVABLE: Power County Chief Deputy Clerk Linda Annen appeared before the Commissioners to present a copy of the Customer Balance Summary Report of “past due” receivable accounts for indigent medical services as of September 30th, 2011. Following discussion, the Commissioners agreed that no accounts are uncollectible or need to be “written off” at this time. Following further discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the Power County Indigent accounts receivable report as presented. Carried.
ARBON VALLEY HERD DISTRICT: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to discuss the Arbon Valley Herd District, which was established by the Board of Power County Commissioners on July 27th, 1918 (Book 1, Page 358). At the outset, Prosecuting Attorney Kline reported that he will be giving written notice to all affected residents that the Arbon Valley Herd District must be restructured and organized in order to enforce the provisions of I.C. #25-2401, et seq.
POWER COUNTY RURAL ADDRESS SYSTEM (IDAHO ENHANCED 911) – FORT HALL INDIAN RESERVATION: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to present a draft copy of the written notice to all households within the common boundaries of Power County and the Fort Hall Indian Reservation that obtaining a “new address” under the Shoshone-Bannock Tribe’s proposed enhanced 911 system is not necessary, and may ultimately be detrimental to the health, safety and welfare of the many non-tribal residents in that area when an E-911 emergency call is required. Following discussion, Prosecuting Attorney Kline reported that the notices would be mailed before the end of the week.
SOUTHEASTERN DISTRICT HEALTH DEPARTMENT – FORT HALL INDIAN RESERVATION (SEWAGE DISPOSAL REGULATIONS): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to review the memorandum from the Idaho Department of Environmental Quality to the Southeastern District Health Department dated September 8th, 2011, giving official notice that, effective immediately, the Shoshone-Bannock Tribes shall have concurrent authority and jurisdiction, along with the State of Idaho, to regulate subsurface sewage disposal systems within the boundaries of the Fort Hall Indian Reservation, including those systems of non-tribal members located on non-tribal member owned lands, and directing the Health Department to refer those persons seeking sewage disposal permits to the Tribes. Following discussion, the Commissioners instructed Prosecuting Attorney Kline to make a formal written request to the State of Idaho’s Director of Environmental Quality Toni Hardesty, that the memorandum be withdrawn until Power County’s input, objections and concerns have been properly and publically addressed, with copies of said request to be provided to Idaho Governor C.L. “Butch” Otter and Attorney General Lawrence Wasden. Following further discussion, the Commissioners instructed Prosecuting Attorney Kline to provide written notice to all households within the common boundaries of Power County and the Fort Hall Indian Reservation that any and all sewage permits must be obtained in accordance with Power County Code.
POWER COUNTY BUILDING & GROUNDS – ZIMMERMAN FARM LEASE: Commissioner Funk reported that he had been contacted by David Zimmerman regarding the Farm Lease Agreement for 73.4 farmable acres of County property, which Lease Agreement will expire on November 1st, 2014. Commissioner Funk further reported that Mr. Zimmerman misunderstood the sub-lease provision and intends to personally operate these farmable acres throughout the remainder of the lease.

MOUNTAIN STATES TRANSMISSION INTERTIE (MSTI): Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the joint letter of Power and Cassia Counties and the corresponding Citizens’ Task Force groups to the U.S. Department of Interior requesting that the Mountain States Transmission Intertie (MSTI) project be reassigned to an alternate Project Manager, upon the condition that the joint letter is also approved by all parties thereto. Carried.
GATEWAY WEST TRANSMISSION LINE: Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the joint letter of Power and Cassia Counties and the corresponding Citizens’ Task Force groups to the Idaho Public Utilities Commission objecting to any rate increase proposed by Idaho Power to recover costs incurred, or generate funding for, the Gateway West Transmission Line project, upon the condition that the joint letter is also approved by all parties thereto. Carried.
FISCAL YEAR 2012 – AUTHORIZED FUND TRANSFERS: Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve the following budgeted fiscal year 2012 fund transfers:

POWER COUNTY BUILDING & GROUNDS – SNOW REMOVAL: The Commissioners reviewed the quote received for snow removal at the Power County Courthouse and Annex during the upcoming winter season. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and accept the quote submitted by ABC Snow Removal in the amount of $225.00 per service. Carried.
POWER COUNTY CLERK – FISCAL YEAR 2011 AUDIT (DEATON & COMPANY): Power County Clerk & Auditor Christine Steinlicht appeared before the Commissioners to report that Power County Fiscal Year 2011 has been fully balanced and will be formally closed on October 25th, 2011, after which the initial audit information will be provided to Charles Clark and Brandi Young at Deaton & Company.
CLOUD SEEDING – POWER COUNTY: Following discussion, Commissioner Meadows agreed to contact Power County Weed Department Supervisor Curtis Munk to discuss the cloud seeding operation in Power County for the upcoming snow season.
POWER COUNTY TRANSFER STATION/LANDFILL – ACCOUNTS RECEIVABLE: Power County Transfer Station/Landfill Supervisor Craig Heward appeared before the Commissioners to review the Power County Landfill’s Customer Balance Summary of accounts receivable as of September 30th, 2011. Following discussion, the Commissioners agreed that no accounts are uncollectible or need to be “written off” at this time. Following further discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve receivable report as presented. Carried.
POWER COUNTY CONFLICT PUBLIC DEFENDER – RESIGNATION: The Commissioners reviewed the written resignation of Benjamin Neilsen of the law firm Loveless, Neilsen & Loveless for Power County’s conflict public defender services, effective immediately. Following discussion, it was moved by Commissioner Meadows, seconded by Anderson, to appoint Jared A. Steadman of the law firm Merrill & Merrill, Chartered, who has been serving as deputy conflict public defender during Mr. Neilsen’s recent absences, to fill in as Power County Conflict Public Defender until November 30th, 2010, under the same terms and conditions of that Agreement dated July 12th, 2010. Carried.
POWER COUNTY BUILDING & GROUNDS – CONCRETE DEMOLITION, BACKFILL & PAVING (CALL FOR BIDS): The Commissioners reviewed the quotes submitted for excavation, concrete and backfill work that needs to be done on County grounds adjacent to the Power County Courthouse. Following discussion, it was moved by Commissioner Anderson, seconded by Commissioner Meadows, to approve the quotes submitted by Eagle Rock Excavation in the total amount of $1,742.50. Carried.
POWER COUNTY BUILDINGS & GROUNDS – 528 GIFFORD: Commissioner Anderson reported that he has been contacted by Power County resident Gary Thomson, who purchased the structure situated upon Power County Parcel #RPA1021-00, also known as 528 Gifford Avenue, at public auction on August 22nd, 2011, and has indicated that he will be unable to remove the structure prior to the October 11th deadline. Commissioner Anderson further reported that Mr. Thomson is also investigating alternatives, such as demolition of the structure at its current site or re-selling the structure upon the condition of immediate removal. Following discussion, the Commissioner agreed to discuss possible demolition of the structure with Great Basin Asbestos Services out of Blackfoot, Idaho, and further consideration of this matter was tabled until October 24th, 2011.
POWER COUNTY JUVENILE PROBATION DEPARTMENT – JAIBG GRANT (PARENT PROJECT): Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the JAIBG Project Award for Power County to operate the Parent Project Program during fiscal year 2012 in the amount of $5,700, which requires $633 in matching funds. Carried.
2011 REAPPORTIONMENT COMMITTEE – PUBLIC HEARINGS: Commissioner Meadows reported that she and Commissioner Anderson had attended the 2011 Reapportionment Committee’s public hearing held in Idaho Falls on October 5th, 2011. Commissioner Meadows further reported that 2011 Reapportionment Committee has expressed their desire to approve and adopt a legislative district map within the next several weeks.
POWER COUNTY AMBULANCE DISTRICT: Moved by Commissioner Meadows, seconded by Commissioner Funk, to recess as Power County Board of Commissioners and reconvene as Power County Ambulance District Board. Carried.
AMBULANCE – DISPATCH GUIDELINES: Following discussion with Power County Sheriff Jim Jeffries, the Commissioners agreed to table further consideration of this matter until October 31st, 2011.
Moved by Commissioner Funk, seconded by Commissioner Anderson, to recess as Power County Ambulance District Board and reconvene as Power County Board of Commissioners. Carried.
POWER COUNTY PROSECUTING ATTORNEY/COMMISSIONERS – LITIGATION: Moved by Commissioner Anderson, seconded by Commissioner Meadows to approve and execute the Contract to Employ Legal Counsel Meyers Law Office, PLLC to represent and advise the Board of Power County Commissioners in all matters pertaining to Power County Case #CV-2011-248. Carried.
POWER COUNTY TREASURER – TAX DEEDED PARCEL (IDAHO DEPARTMENT OF ENVIRONMENTAL QUALITY): Commissioner Meadows announced that she had been contacted by Kristen Jensen of Great Rift Business Development, who has been advised by the Idaho Department of Environmental Quality that access to “Brownsfield Program” funding will be unavailable during the foreseeable future; accordingly, Power County’s application for an assessment to be performed to determine the particulate level of asbestos in and around the structure situated on Parcel #RPA0812-00 will be held in abeyance for an indefinite period. Following discussion, the Commissioners agreed to contact Great Basin Asbestos Services in Blackfoot, Idaho, to request that they update their initial asbestos study dated February 18th, 2009, and make recommendations for disposal and/or demolition. Further consideration of this matter was tabled until October 24th, 2011.
IDAHO ASSOCIATED TAXPAYERS OF IDAHO: Commissioner Meadows reported that the 65th Annual Conference of the Associated Taxpayers of Idaho has been scheduled for Thursday, December 1st, 2011, from 8:30 a.m. until 3:15 p.m. at the Boise Centre, downtown Boise.

COMMISSIONER MINUTES
The Board of Power County Commissioners met in special session on Wednesday, October 19th, 2011. Present were Commissioners Vicki Meadows, Chairman and Delane Anderson. Also present were Power County Clerk Christine Steinlicht and Power County Prosecuting Attorney F. Randall Kline.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Power County’s Table Mountain Project Director Ken Estep appeared before the Commissioners to discuss the Table Mountain 700 MHz project. Also present via telephone conference call were Idaho Bureau of Homeland Security Director Brigadier General William Shawver, Assistant Director Jim Brede and Public Information Officer Robert Feeley. Also present were Power County Sheriff Jim Jeffries and Deputy Sheriff Kevin Ostler. At the outset, Mr. Estep reported that Power County is planning to begin full operation of the Table Mountain Repeater beginning November 4th, 2011, and requested that the Idaho Bureau of Homeland Security accommodate connectivity to the master site in Meridian, Idaho, with Power County to provide a connector link between Table Mountain and Paps Mountain. General Shawver suggested that Power County must first complete the Memorandum of Understanding process for the Kinport Repeater Site before the Idaho Bureau of Homeland Security will consider any further connectivity projects in Power County. Sheriff Jeffries and General Shawver then discussed the fees being assessed to individual subscriber agencies by Ada County for its administration of the Master Site. General Shawver explained that the Bureau of Homeland Security’s “long-haul” connectivity fee for the master site, which is a one circuit connection that cannot be separated out per agency, is separate and apart from other fees and has been billed solely to each County and not to individual subscriber agencies; likewise, any Memorandum of Understanding for Kinport Peak, Table Mountain or Paps Mountain would be solely between Power County and the Idaho Bureau of Homeland Security. General Shawver then reported that additional funding for the Table Mountain Repeater project may be available from excess Homeland Security allocations and any additional funding requests should be administered through Power County’s disaster services director. Following further discussion, the Commissioners and General Shawver agreed to meet personally at the Power County Courthouse on Tuesday, October 25th, 2011, at 10:00 a.m., and further consideration of this matter was tabled until that time.

POWER COUNTY SHERIFF – IDAHO EMERGENCY COMMUNICATIONS COMMISSION (GRANT AWARD): Following discussion with Power County Sheriff Jim Jeffries, it was moved by Commissioner Anderson, seconded by Commissioner Funk, to approve and execute the Idaho Emergency Communications Commission Grant Award in the amount of $57,900 to upgrade Power County’s Enhanced 911 Center. Carried.
POWER COUNTY SHERIFF – HATE CRIME INVESTIGATION (REWARD): Following discussion with Power County Sheriff Jim Jeffries, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to ratify Power County’s contribution of $1,000 to the Power County Sheriff’s reward fund for any information which results in the arrest and conviction of any individual involved in the recent hate crimes perpetrated against the Rockland Congregational Church. Carried.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Don Haskins of the Power County Highway District appeared before the Commissioners to report on the progress of the access road being constructed to the Table Mountain Repeater Site. Mr. Haskins reported that Idaho Power has completed the power project and concrete will be poured at the site sometime this week; however, it is unlikely that the site will be fully operational by November 4th, 2011. Following discussion, the Commissioners assured Mr. Haskins that the Power County Highway District would be fully reimbursed for all costs involved in getting the access road constructed.
2011 REAPPORTIONMENT COMMITTEE: The Commissioners then reviewed Legislative Plan L87 which was unanimously adopted by the 2011 Idaho Reapportionment Committee on October 14th, 2011, and keeps Power County wholly within Legislative District #27, along with all of Cassia County and a portion of Twin Falls County.
DOCTORS CLINIC – RENOVATIONS: Commissioner Meadows reported that Power County’s Building & Grounds Supervisor Gary Thomson is obtaining quotes to renovate the Power County Doctors Clinic. Following discussion, the commissioners agreed to table further consideration of this matter until October 31st, 2011.
POWER COUNTY HOSPITAL DISTRICT – FLEX PROGRAM GRANTS (LETTER OF SUPPORT): Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to issue a letter supporting the Power County Hospital District’s FLEX Program Grant Application to the Idaho Office of Rural Health and Primary Care to obtain funding to pay for a three year license for an Interqual Web Program that will enable the medical staff to make more informed decisions regarding inpatient admissions. Carried.
COLLEGE OF SOUTHERN IDAHO – CERTIFICATE OF RESIDENCY: Moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Certificate of Residency submitted by the College of Southern Idaho. Carried.
POWER COUNTY BUILDING & GROUNDS – 528 GIFFORD: Commissioner Anderson reported that Great Basin Asbestos Services suspects that traces of asbestos may exist in the siding on the structure located at 528 Gifford Avenue; however, a full asbestos abatement study has not been completed. Following discussion, the Commissioners agreed to table further consideration of this matter until October 31st, 2011.
POWER COUNTY SHERIFF – JAIL REMODEL: Power County Sheriff Jim Jeffries appeared before the Commissioners to discuss remodel of the Power County Jail. Also present were Architect Lee Dille of Design Place, PLLC, and Gary Ferguson d/b/a BGM Builders. At the outset, Mr. Ferguson recommended that the Commissioners consider hiring Mr. Dille to design Power County’s jail remodel plans. The Commissioners, Sheriff Jeffries and Mr. Dille then discussed several options for remodel. Following discussion, Mr. Dille agreed to review the various options and prepare an official design plan and cost estimate and further consideration of this matter was tabled until October 31st, 2011.
POWER COUNTY CONFLICT PUBLIC DEFENDER: Following telephone conference with Power County’s interim Conflict Public Defender Jared Steadman of the law firm Merrill & Merrill, Chartered, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to publish “NOTICE OF CALL FOR SEALED BIDS” in the November 2nd and 9th, 2011, editions of The Power County Press inviting all individuals who are licensed to practice law in the State of Idaho, and in good standing with the Idaho State Bar Association, to submit a sealed bid for contracted conflict public defender services in Power County commencing December 1st, 2011, and continuing until September 30th, 2013, with all sealed proposals to be submitted to the Power County Clerk by 5:00 p.m. on November 25th, 2011. POWER COUNTY COMMISSIONER DISTRICTS – REAPPORTIONMENT: Derrick Sharp of Whisper Mountain Professional Services, Inc., appeared before the Commissioners to discuss reapportionment of Power County’s Commissioner District boundaries following the decennial federal census to ensure equal representation. Mr. Sharp then presented several reapportionment proposals that would reset Commissioner District boundaries in accordance with redistricting guidelines. Following discussion, the Commissioners agreed to review the proposals submitted and this matter was tabled until November 14th, 2011.

POWER COUNTY RURAL ADDRESS SYSTEM (IDAHO ENHANCED 911) – FORT HALL INDIAN RESERVATION: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to discuss the Fort Hall Tribal Council’s intentions to adopt a rural address system within the boundaries of the Fort Hall Indian Reservation, which conflicts with Power County’s current Rural Address System. At the outset, Prosecutor Kline reported that, as requested by the Board of Power County Commissioners, he is holding the written notice to all households within the common boundaries of Power County and the Fort Hall Indian Reservation that obtaining a “new address” under the Shoshone-Bannock Tribe’s proposed enhanced 911 system is not necessary, and may ultimately be detrimental to the health, safety and welfare of the many non-tribal residents in that area when an E-911 emergency call is required. Following discussion, the Commissioners agreed that they may need additional time to review the Notice and further consideration of this matter was tabled until October 31st, 2011.
SOUTHEASTERN DISTRICT HEALTH DEPARTMENT – FORT HALL INDIAN RESERVATION (SEWAGE DISPOSAL REGULATIONS): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to review the formal written request to the State of Idaho’s Director of Environmental Quality Toni Hardesty, that the memorandum from the Idaho Department of Environmental Quality to the Southeastern District Health Department dated September 8th, 2011, giving official notice that the Shoshone-Bannock Tribes shall have concurrent authority and jurisdiction, along with the State of Idaho, to regulate subsurface sewage disposal systems within the boundaries of the Fort Hall Indian Reservation be withdrawn until Power County’s input, objections and concerns have been properly and publically addressed, with copies of said request to be provided to Idaho Governor C.L. “Butch” Otter and Attorney General Lawrence Wasden. Following discussion, the Commissioners agreed that they may need additional time to review the written request and further consideration of this matter was tabled until November 14th, 2011.

POWER COUNTY TREASURER – ORDER FOR CANCELLATION OF TAXES: Following discussion with Power County Treasurer Deanna Curry, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Order for Cancellation of Taxes in the amount of $1,057.20 as presented. Carried.
POWER COUNTY TREASURER – TAX DEEDED PROPERTY (PARCEL #RPA0331-08 – 558 ARTHUR): Power County Treasurer Deanna Curry appeared before the Commissioners with Power County Prosecuting Attorney Randy Kline to discuss tax deeded parcel #RPA0331-08. At the outset, Treasurer Curry reported that the personal property tax parcel (trailer house) which is situated upon Power County Parcel #RPA0331-08 is current on all tax obligations and no warrant of distraint is pending or anticipated. Following discussion with Power County Prosecuting Attorney Randy Kline, the Commissioners agreed to give written notice to the owner of the trailer house situated upon Power County’s property located at 558 Arthur, American Falls, that the trailer must be immediately removed from the premises. Further consideration of this matter was tabled until November 14th, 2011.
POWER COUNTY TREASURER – TAX DEEDED PROPERTY (PARCEL #RPA0812-00 – 276 ROOSEVELT): Power County Treasurer Deanna Curry appeared before the Commissioners to discuss Parcel #RPA0812-00, which is located at 276 Roosevelt Street, American Falls, and is owned by Power County pursuant to Tax Deed. At the outset, Commissioner Anderson reported that the asbestos study being conducted by Great Basin Asbestos Services has not been completed. Following discussion, the Commissioners agreed to table further consideration of this matter until November 14th, 2011.

POWER COUNTY TRANSFER STATION/LANDFILL – EQUIPMENT PURCHASE: Jim Betty of Western States Equipment appeared before the Commissioners to discuss the purchase of a 963D Caterpillar Waste Handler for use at the Power County Transfer Station/Landfill. At the outset, Commissioner Anderson reported that he has investigated the equipment other similarly sized Counties, i.e. Oneida and Butte, utilize to maintain the construction and demolition pits at their transfer stations or landfills, and the consensus is that the Bomag B5 Compactor is not suitable for landfill uses. Commissioner Anderson then requested an emergency expenditure by the Board of Commissioner as provided by I.C. #67-5247, for the following reasons:
• Western States Equipment Company has declared Power County’s current 1980 Bomag B5 Compactor as “hazardous equipment” unsafe for further operation.
• Immediate danger exists to the health, safety and welfare of Power County Transfer Station and Landfill employees by continued or further use of the Bomag B5 Compactor, and immediate action by the Board is necessary to prevent or avoid that danger.
Accordingly, it was moved by Commissioner Anderson, seconded by Commissioner Meadows, to enter into a joint purchasing agreement under the State of Idaho, as provided by I.C. #67-2807, and accept the quote presented by Western States Equipment for the purchase of a 963D Caterpillar Waste Handler for use at the Power County Transfer Station and Landfill in the total amount of $287,806.48, less scrap metal value of Power County’s 1980 B5 Compactor in the amount of $5,600, for a balance purchase price of $282,206.48 to be paid as follows:

$157,206.48 from PILT Contingency

The Board of Power County Commissioners met in regular session on Tuesday, October 25th, 2011. Present were Commissioners Vicki Meadows, Chairman, Ron Funk and Delane Anderson. Also present was Power County Clerk Christine Steinlicht.
POWER COUNTY COMMUNICATIONS – TABLE MOUNTAIN REPEATER SITE: Power County Table Mountain Project Director Ken Estep appeared before the Commissioners to discuss the Table Mountain 700 MHz project. Also present were:

At the outset, General Shawver reported that the State of Idaho Bureau of Homeland Security is anxious to partner with local governments to enhance communications state-wide, especially in rural and remote areas, including the Table Mountain site; however, the Memorandum of Understanding between the State of Idaho and Power County to provide connectivity from Kinport Peak via the State’s Communication sites located at Chinese Peak and Paps Mountain to the master site located in Meridian, Idaho, which has been under review by Power County, must be finalized and executed prior to proceeding with Table Mountain connectivity. Mr. Steiner then explained that the Bureau of Homeland Security’s annual fee under the Memorandum of Understanding is separate and apart from the subscriber fee charged by Ada County for administration of the master site, is based on the State’s standard rate for building space, access and connectivity to support the trunked radio system that Power County has connected to the master site and cannot be billed out to individual subscriber agencies. Mr. Steiner further reported that nothing in the Memorandum of Understanding would preclude Power County, as the sole owner of the one circuit connection box, from negotiating contracts with other local entities or individuals who utilize that County infrastructure and suggested that the Board of Commissioners investigate what other Counties have negotiated with respect to sharing costs with local subscribers or perhaps investigate the possibility of a regional communications system to partner with adjacent counties and reduce costs. Following further discussion, General Shawver reported that the Idaho Bureau of Homeland Security would be willing to “write-off” Power County’s 2010 annual fee if the 2011 annual fee could be brought current and the Kinport Memorandum of Understanding finalized and executed. Paul Clark of Clark Radio then reported that the Table Mountain 700 MHz project should be fully operational by November 15th, 2011, and suggested that the Board of Commissioners finalize a Memorandum of Understanding as soon as possible in order to accommodate co-location at the Paps Mountain and connectivity of Table Mountain to the master site in Meridian. Following discussion, the Commissioners agreed to table further consideration of this matter until October 31st, 2011.

POWER COUNTY DISASTER SERVICES – HOMELAND SECURITY GRANTS: Following discussion with Power County Disaster Services director Di Jones, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Idaho Bureau of Homeland Security’s 2011 Emergency Management Performance Grant Award Document #EMW-2011-EP-00082 in the amount of $11,056.82 as presented. Carried.
POWER COUNTY COMMUNICATIONS – KINPORT/TABLE MOUNTAIN REPEATER SITES: Following discussion with Power County Sheriff Jim Jeffries and Power County Disaster Services Director Di Jones, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to approve and execute the Memorandum of Understanding between the State of Idaho Bureau of Homeland Security and Power County to provide connectivity from the State’s communication sites located at Chinese Peak and Paps Mountain to the master site located in Meridian, Idaho, in order to maintain a circuit connection from the County’s Kinport and Table Mountain sites to the State’s master site for an annual fee of $8,510. Carried.
POWER COUNTY COMMUNICATIONS – STATEWIDE RADIO SYSTEM MANAGEMENT (MASTER SITE): Power County Sheriff Jim Jeffries appeared before Commissioners to present a copy of the proposed Statewide Radio System’s Standard Operation Procedures Manual for the Master Site located in Meridian, Idaho, which is administered by Ada County. Following discussion, the Commissioners suggested that Sheriff Jeffries coordinate a joint meeting of the following entities to review the proposed Procedures Manual and accompanying Participant Agreement:
• Power County
• Power County Ambulance District
• Power County Highway District
• City of American Falls
• American Falls Rural Fire District
• Rockland Fire District
• American Falls School District #381

POWER COUNTY SHERIFF – ENHANCED 911 AGREEMENT: Following discussion with Power County Sheriff Jim Jeffries, it was moved by Commissioner Meadows, seconded by Commissioner Funk, to authorize Power County Sheriff Jim Jeffries to execute the Services Agreement between Motorola Solutions and Power County for technician services at the County’s Enhanced 911 Dispatch Center during Fiscal Year 2012. POWER COUNTY SHERIFF – JAIL REMODEL: Power County Sheriff Jim Jeffries appeared before the Commissioners with Lee Dille of Design Place, PLLC, to review the standard form Agreement with Power County to provide architectural services for the Power County law enforcement building renovation project. Following discussion and approval by Power County Prosecuting Attorney Randy Kline, it was moved by Commissioner Funk, seconded by Commissioner Anderson, to approve and execute the Architect Agreement as presented. Carried.
POWER COUNTY SHERIFF – DEPUTY ASSOCIATION: Power County Sheriff Jim Jeffries appeared before the Commissioners to report that he may be investigating the possibility of establishing the “Power County Sheriff’s Deputy Association” to involve and educate members of the public in law enforcement operations within Power County, similar to the program recently implemented in Oneida County. Following discussion, Sheriff Jeffries agreed to keep the Commissioners apprised if this investigation proceeds.
POWER COUNTY RURAL ADDRESS SYSTEM (IDAHO ENHANCED 911) – FORT HALL INDIAN RESERVATION: Power County Sheriff Jim Jeffries appeared before the Commissioners to discuss the Fort Hall Tribal Council’s intentions to adopt a rural address system within the boundaries of the Fort Hall Indian Reservation, which conflicts with Power County’s current Rural Address System. At the outset, Sheriff Jeffries reported that he had discussed this issue with a representative of Century Link, Power County’s E-911 telephone service provider, who has assured Sheriff Jeffries that unless a formal written agreement is negotiated between Power County and the Shoshone Bannock Tribes, no address changes within the common boundaries of Power County and the Fort Hall Indian Reservation will be recognized through Power County’s Enhanced 911 System. Following discussion, the Commissioners agreed to table further consideration of this matter until November 14th, 2011.
FORT HALL INDIAN RESERVATION – SEWAGE DISPOSAL REGULATIONS (SOUTHEASTERN DISTRICT HEALTH DEPARTMENT): Bruce Olenick of the Idaho Department of Environmental Quality appeared before the Commissioners to discuss the State Department of Environmental Quality’s (DEQ) memorandum dated September 8th, 2011, to the Southeastern District Health Department (SDHD) regarding subsurface sewage disposal systems within the boundaries of the Fort Hall Indian Reservation. Mr. Olenick reported that State DEQ Director Toni Hardesty will be issuing a follow-up letter to SDHD to clarify the jurisdictional and regulatory relationships between the two agencies and to further define DEQ’s position with regard to the September 8th memorandum. Following discussion, the Commissioners agreed to review a copy of the follow up letter prior to proceeding further; accordingly, further consideration of this matter was tabled until November 14th, 2011.
DOCTORS CLINIC – RENOVATIONS: The Commissioners reviewed a quote from Pankratz & Son Building Contractors to remove an area of brick at the Doctors Clinic and to install shingles in the amount of $6,315.32. Following discussion, it was moved by Commissioner Meadows, seconded by Commissioner Anderson, to approve the quote as presented. Carried.
POWER COUNTY BUIILDING & GROUNDS – 528 GIFFORD: Following discussion, the Commissioners agreed to table further consideration of this matter until November 14th, 2011.
ROCK CLIMBING – MASSACRE ROCKS STATE PARK (BUREAU OF LAND MANAGEMENT): Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to review the Memorandum of Understanding between the Bureau of Land Management and Power County concerning the proposed monument resource management plan amendment to close a portion of the Cedar Field Archaeological District to rock climbing, staging, camping and trail building. Following discussion, Prosecuting Attorney Kline reported that he will be submitting a list of Power County’s proposed amendments to BLM Field Manager Mike Courtney and further discussion of this matter was tabled until November 14th, 2011.
ARBON VALLEY HERD DISTRICT: Power County Prosecuting Attorney Randy Kline appeared before the Commissioners to further discuss the Arbon Valley Herd District, which was established by the Board of Power County Commissioners on July 27th, 1918 (Book 1, Page 358). At the outset, Prosecuting Attorney Kline reported that he will be scheduling a meeting of affected residents in the Arbon Valley area to discuss reorganization and enforcement of Herd Districts as provided by I.C. #25-2401, et seq. Following discussion, the Commissioners agreed to table further consideration of this matter until November 14th, 2011.
