Cody Sellers, who was convicted in 2014 in American Falls of felony injury to a child, appealed his case to Idaho Court of Appeals. Sellers was convicted in a rare jury trial. He was found guilty of four felonies and a misdemeanor.
The court of appeals upheld his original conviction, filing an opinion on the matter on Thursday, Sept. 1.
Sellers made his case that the jury received inadequate instructions because they were not told that a felony conviction required “circumstances or conditions likely to produce great bodily harm or death.” Originally, his attorney said that Sellers convictions should all be misdemeanors because of the mistake. …
